1. About these terms
These terms and conditions (the “Terms”) govern your use of the MarketGini website at marketgini.com and the MarketGini research application (together, the “Service”). The Service is provided by MarketGini (“we”, “us”, “our”).
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. Not financial advice
Important: MarketGini provides general information and research tools only. Nothing on the Service — including AI answers, sentiment ratings, signal scores, screener rankings, charts or any other content — is investment, financial, tax or legal advice, or a personal recommendation to buy, sell or hold any investment.
We are not authorised or regulated by the Financial Conduct Authority to give investment advice. Content does not take your personal circumstances, objectives or attitude to risk into account. The value of investments and any income from them can fall as well as rise, and you may get back less than you invest. Past performance is not a reliable indicator of future results. Investments in overseas markets are also affected by currency movements.
You are solely responsible for your investment decisions. If you are unsure whether an investment is suitable for you, speak to an FCA-authorised financial adviser.
3. Your account
- You must be at least 18 years old to create an account.
- You must give us accurate information, including a valid email address, and keep it up to date.
- You are responsible for keeping your password secure and for all activity on your account. Tell us straight away through our contact form if you think someone else has accessed it.
- Accounts are personal. You must not share your login or let other people use your account or allowance.
4. Plans and AI allowances
We offer the following plans. Every plan includes share overviews, screeners and watchlists. Plans differ by the number of questions you can ask Ask Gini, our AI research assistant, each day, by watchlist limits, by access to interactive charts and technical analysis, and by support priority.
| Plan | Price | AI questions per day | Charts & technical analysis | Watchlists | Email support |
|---|---|---|---|---|---|
| Free | Free | 2 | Not included | 1 watchlist of up to 5 shares | Standard |
| Pro | £9.99 per month | 20 | Included | 10 watchlists of up to 20 shares each | Standard |
| Professional | £19.99 per month | 50 | Included | 20 watchlists of up to 50 shares each | Priority |
Each message sent to Ask Gini, including follow-up questions, counts as one AI question. Allowances reset at midnight UK time and unused questions do not roll over. Questions that fail because of a technical problem on our side are not counted. We may apply reasonable fair-use and rate limits to protect the Service. The full feature list for each plan is shown on our pricing page.
5. Subscriptions and billing
- Payment. Paid plans are billed monthly in advance in pounds sterling (GBP), including VAT where applicable, using the payment method you provide. Your subscription renews automatically each month until you cancel.
- Cancelling. You can cancel at any time. Your paid plan will continue until the end of the billing period you have already paid for, after which your account moves to the Free plan. We do not provide refunds for partial months, except where required by law.
- Your right to cancel. If you are a consumer in the UK, you have a legal right to cancel a new subscription within 14 days of purchase. If you ask us to start the paid service during that period, you agree that we may deduct an amount proportionate to the service you have received.
- Upgrades and downgrades. Upgrades take effect immediately. Downgrades take effect from your next billing date.
- Price changes. We will give you at least 30 days’ notice by email of any price change to your subscription. If you do not agree, you can cancel before the change takes effect.
- Failed payments. If we cannot collect a payment, we may move your account to the Free plan until payment is made.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, fraudulent or harmful, including market abuse or market manipulation;
- scrape, crawl, copy, resell, redistribute or commercially exploit the Service or its data, or use it to build a competing product;
- use automated tools, bots or scripts to access the Service, except through interfaces we expressly make available for that purpose;
- try to get around plan limits, rate limits or security measures, or access accounts or data that are not yours;
- interfere with, overload or disrupt the Service, or introduce malware; or
- submit content to Ask Gini or our contact form that is unlawful, abusive or infringes anyone else’s rights, or that contains other people’s personal data.
7. Market data and AI content
Market data, including prices, fundamentals, dividends, analyst estimates and news, is obtained from third-party sources. Prices may be delayed and data may be incomplete, out of date or inaccurate. Always check information with your broker or another reliable source before acting on it.
Ask Gini uses artificial intelligence to generate answers. AI-generated content can be wrong, incomplete or misleading, even when it sounds confident. Technical signals and scores are produced by automated formulas and are not predictions. You should independently verify anything you rely on.
8. Intellectual property
The Service, including its software, design, text, graphics, logos and the MarketGini name, belongs to us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own personal, non-commercial research while your account is active. Third-party data remains the property of its providers.
9. Third-party services
The Service relies on third-party providers for things such as market data, AI processing, bot protection, email and hosting, and may link to third-party websites (for example, news articles). We are not responsible for third-party websites or content, and your use of them may be subject to their own terms.
10. Availability and changes
We work hard to keep the Service available, but we do not guarantee that it will always be available, uninterrupted or error-free. We may need to suspend the Service for maintenance, security or reasons outside our control. We may change, add or remove features from time to time to improve the Service. If we make a change that significantly reduces the features of a paid plan you are subscribed to, we will tell you in advance and you may cancel.
11. Our liability to you
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Nothing in these Terms affects your statutory rights as a consumer.
Subject to that:
- we are not liable for any investment or trading losses, or any loss of profit, income or opportunity, arising from your use of, or reliance on, the Service or its content;
- we are not liable for losses that were not reasonably foreseeable, or that were caused by events outside our reasonable control; and
- our total liability to you in connection with the Service in any 12-month period is limited to the greater of the amount you paid us in that period and £100.
The Service is provided for personal use. If you use it for business purposes, we have no liability to you for any loss of business, business interruption or loss of business opportunity.
12. Suspension and closure
You can stop using the Service and delete your account at any time from Manage account in the app, or ask us to close it through our contact form. If you have a paid subscription that is still active — including one you have cancelled whose paid period has not yet ended — you need to cancel it and wait for it to end before you can delete your account (see “Cancelling” in section 5). Deleting your account is permanent and your watchlists and other content cannot be restored. We may suspend or close your account if you seriously or repeatedly break these Terms, if we are required to by law, or if we stop providing the Service. Where reasonable, we will give you notice first. If we close your account without cause, we will refund any amount you have paid for a period you will not receive.
13. Changes to these terms
We may update these Terms from time to time, for example to reflect changes to the Service or the law. We will show the effective date at the top of this page and, for material changes, notify you by email or in the app at least 30 days in advance. If you continue to use the Service after the changes take effect, you accept the updated Terms.
14. Governing law
These Terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
